The ownership with the up-front payment is for the freelance services of Couch Gregor. With the principal place to his business relationship upon full payment of transference of IP.
A. With the designated hire from the organizer/collaborator, With thumbnails and early revisions given beforehand, 1-3 revisions completed in total. With further revisions given in prompt. More revisions beyond that, then I'll have to charge.
B. New clients will have to be charged upfront even before thumbnails, trusted clients can have ideas experiments with half charged up in front in the phase.
C. Owner owns the copyright to certain materials relating to commissioned services of Ko-fi/boosty/paypal and is willing to allow the organizer/collaborator to copy and use such materials under the terms herein set forth.
(Giving credit is encouraged.)
With all being written, the promises made thereof. The Couch Gregor and collaborator agree as follows:
1. This agreement shall be effective on the date made by the money given through the Ko-Fi or other commission site.
2. Couch Gregor grants the collaborator a non-exclusive right to copy certain materials described in a clip studio PNG, in whole and in part, into other works. For internal use only.
3. All right, title, and interest in the material, including without limitation, any copyright, shall remain with Couch Gregor.
4. Couch Gregor shall own the copyright in the derivative works.
5. Deritive works include: Defacement, usage of work within AI learning and minting for NFTs.
6. A kill fee will also issue if the collaborator is unsuccessful in collaboration with deritive works. Couch Gregor will retain copyright and blacklist. With completion calculated and repaid to lift blacklist.
7. This agreement may be terminated by the written agreement of both parties, in an event the other party shall be in default of its material obligations under the agreement shall fail to remedy such default within sixty days after receipt of written notice thereof, this agreement shall terminate upon expiration of the sixty-day period.
8. Through collaboration on Couch Gregor's part, a refund will be granted after the thumbnail. Otherwise, after the refinement stages complete, no refund will be granted at the stage.
9. The given commission is incorporated herein and made a part hereof for all purposes
10. I reserve the right to refuse the request for any reason, be it within the constraints of what is asked.
In witness whereof, the parties hereto have cause their duly authorized representative to execute this agreement.
