I am very sick and tired of people bringing up “consent” as a reason for why transformative works should be disallowed. Yes, even when the transformative works involve lots of complicated machine statistics. Firstly, consent is for sex and risky activities, not “am I allowed to use bits of your work?”
This absurd watering down of consent from “a thing that determines whether or not you were sexually assaulted” to “you asked permission of the IP owner if you could so graciously use a crumb of Mickey Mouse” is not only stupid—it’s also extremely offensive, and I don’t understand how it became popular.
But furthermore: I can promise you that you don’t actually want to live in the world where you need someone’s permission to transform their works, because that’s actually more restrictive than our current world—which, thank god, has the fair use doctrine + transformative works as a legal category.
This is the world in which jungle, D&B, vaporwave, just large swathes of the techno and EDM and IDM landscape don’t exist, the world in which huge swathes of rap are eliminated, the world in which you can no longer create parodies of people, the world in which Disney makes even fewer gay people.
This is the world in which you can no longer create collages. This is the world in which open source and copyleft stop being meaningful regimes, including my best friend Creative Commons Zero. This is a world with no found art—did you ask that slavev1l’s creative owner for permission to photo it?
And this asinine demand for “compensation” also ticks me off because it insists that you are allowed to—nay, entitled to—create something once and then live fat off the residuals forever. That is a nice pipe dream! However, I’m going somewhere without currency, so maybe catch up. THIS IS ALSO BAD.
It would be lovely if everyone had enough money to go around—or enough resources, in a moneyless world. This is a great aspirational thing. But what happens in a world where any copyright owner gets to landlord off their ideas forever is the world where the thousand-year Disney Reich exists forever.
It’s the same anti-art mindset that lets the RIAA say: “Well, you downloaded an album illegally, thus denying us six million dollars of hypothetical future profit that we are owed. So we are putting you in jail forever.” If you think this is a leftist idea somehow, I have a bridge to sell you.
This is the same idea that killed Aaron Swartz. This is the same idea that imprisoned Gary Bowser effectively in indentured servitude for life. This is the idea that killed so many comic artists because their ideas are treated as property to be bought, sold, and landlord-ized. It is lethal.
It is lethal carceral reactionary bullshit that relies on impossible mechanisms to embrace in the first place, and so you will, thankfully, NEVER get the world you want.
